COPINH: DENUNCIA URGENTE/ DESA-AGUA ZARCA REIMPULSA PROYECTO HIDROELÉCTRICO ILEGAL E ILEGÍTIMO, VIOLADOR DE DERECHOS Y LA VIDA DEL PUEBLO LENCA Y SUS TERRITORIOS

El Gobierno de Honduras sigue permitiendo y siendo cómplice de la violación de derechos humanos del Pueblo Lenca de Río Blanco y del Norte de Intibucá al respaldar el segundo intento de DESA para construir el Proyecto Hidroeléctrico “Agua Zarca” sobre el mismo Río Gualcarque, patrimonio natural, cultural, económico y hábitat funcional del Pueblo Lenca.

Este nuevo intento de DESA-Agua Zarca está basado en la misma concesión ilegal que ha violado el Derecho de Consulta y Consentimiento Previo, Libre e Informado del Pueblo Lenca, así como el Convenio 169 de la OIT, la Declaración de la ONU sobre Derechos de los Pueblos Indígenas, por lo que desde su origen es ilegítimo e ilegal.

Condenamos a quienes hoy apoyan este proyecto de muerte convirtiéndoles en violadores de derechos históricos, colectivos e individuales del Pueblo Lenca como lo son el Fondo de Desarrollo de los Países Bajos FMO-Banco Holandés que apoya con 15 millones de dólares, igualmente el Finnish Fund for Industrial Cooperation Ltd. FINNFUND de Finlandia con 5 millones de dólares, el Banco Centroamericano de Integración Económica con 24,4 millones de dólares, las empresas Siemens y VoithHydro de Alemania, Empresa CASTOR (CASTILLO TORRES) CONTRUCTORA CERROS DE COMAYAGUA, el Banco FICOHSA y el grupo empresarial de la familia Atala, el gobierno de los Estados Unidos a través de USAID-Proyecto MERCADO y a SERNA, que continúa siendo lacaya de las empresas como DESA, y que se ha negado a entregar al COPINH información de más de 40 proyectos hidroeléctricos que afectan y violan derechos del Pueblo Lenca, incluyendo el PH AGUA ZARCA.

Recordamos que el espurio Congreso de la República en el año 2010 otorgó docenas de concesiones de ríos en toda Honduras, lo que que significa la privatización total de bienes comunes y de la naturaleza, en estos se encuentra la concesión del Río Gualcarque entregado inicialmente por 20 años a la empresa DESA, en este proyecto hemos demostrando una y otra vez y en diferentes formas la barbarie e ilegitimidad; desde la violación a la legislación nacional e internacional hasta la falsificación de firmas, represión y el asesinato de varios miembros del COPINH en esta zona por oponerse al proyecto hidroeléctrico de DESA.

Este proyecto, así como el 2013, continúa manteniendo, ahora con mucho más apoyo, una estructura militar y paramilitar enmascarada con guardias de seguridad, la disposición total de la Policía Nacional sobre todo la ubicada en la Operación Libertad comandada desde Tegucigalpa y para la cual han asignado fondos públicos, logística, comunicación, personal policial, así como de Policía Militar Y Tigres estructurados, financiados y entrenados por los Estados Unidos. No bastando con lo anterior, DESA y la Alcaldía de San Francisco de Ojuera encabezada por el señor Raúl Pineda, alcalde nacionalista han procedido a contratar 50 personas activistas del Partido Nacional, empleados por la Alcaldía y la empresa pagándoles 200 lempiras diarios, más comida, manteniéndoles armados, y con apoyo desde la alcaldía.

DESA- Agua Zarca tiene contratados -como guardias-paramilitares- a reconocidos responsables de crimines que incluyen asesinatos, que han amenazado constantemente a dirigentes comunitarios, nacionales y a compañeras comunitarias del COPINH y permanecen armados. Estos guardias-paramilitares incluso han sido detenidos por portación ilegal de armas como se demostró en las detenciones de uno de ellos el 28 de diciembre del 2015, quienes cobijados por la impunidad y el poder influyente de la empresa DESA fueron puestos en libertad por una fiscal y jueza de Intibucá, abiertamente apoyados con diligencias y dinero movilizando para eso al jefe de seguridad de DESA- PH Agua Zarca Jorge Ávila, sin importar los antecedentes delictivos como el de asesinato en el caso de Bernardo Pérez.

DESA-Agua Zarca está destruyendo el cauce natural del río que es un lugar sagrado para el Pueblo Lenca, está destruyendo ecosistemas únicos, la biodiversidad, la fauna de la zona, zonas de producción agrícola, de alimentación y medicinas naturales, los bosques que ya están arrasados por estas empresas.

DESA Agua Zarca, alega que rediseñó el proyecto, sin embargo queremos denunciar que el PH Agua Zarca está definido a construirse con las aguas del mismo Río Gualcarque, Río que es territorio del Pueblo Lenca, por el cual hemos emprendido una lucha de años, ante la amenaza de privatización.

Empleados y exempleados de DESA-AGUA ZARCA y de la empresa BLUE ENERGY que se ha adueñado y destruido el Río Cangel, igualmente importante como el Guacalque y que también nace en la cordillera de Puca Opalaca, produjeron una acción de irrespeto y amenaza a la delegación del COPINH que acompañaba el 07 de noviembre del 2015 a la Relatora Especial de la ONU para los Derechos de los Pueblos Indígenas, igualmente a la delegación internacional que le acompañaba y a la misma Relatora la Señora Taulis Corpuz a quien retuvieron por algunos minutos.

Así mismo como en 2013, la alcaldía de Intibucá sirvió de testaferro de DESA-AGUA ZARCA, ahora lo hace la Alcaldía de San Francisco de Ojuera, a quienes se les dejó claro en una visita que hicieran a la comunidad de Río Blanco el Rechazo del Pueblo Lenca a este proyecto de acabar con el Río Gualcarque y sus funciones y ecosistemas, en esa reunión el Alcalde Raúl Pineda y su equipo fueron recibidos con respeto y amabilidad, mientras que cuando representantes indígenas nos movilizamos a San Francisco de Ojuera el 30 de noviembre del 2015 a la sede de la municipalidad, fuimos recibidos por parte de esa corporación municipal , sus empleados y manchas bravas del Partido Nacional con amenazas, machetes, armas, acusaciones e insultos racistas, de desprecio y odio a las mujeres del COPINH y por el hecho de ser mujeres indígenas, rebeldes y hacia sus liderazgos llegando a la ridiculez de hacer zanjas profundas a la principal carretera publica para impedir el paso de los buses en los que nos conducíamos, esto usando maquinaria de DESA-AGUA ZARCA.
Existe una amenaza permanente contra la vida, la integridad física y emocional de la población luchadora de Río Blanco e incluso contra la solidaridad, acompañantes, observadores de derechos humanos, periodistas, luchadores y luchadoras nacionales internacionales.

Denunciamos que la empresa DESA, no solo pretende acaparar y destruir el Río Gualcarque sino ahora va también sobre el Río Blanco otro afluente del Gualcarque, sobre el Río GUINSE con un complejo de represas que afecta a San Francisco de Opalaca, Intibucá y Santa Bárbara.

Rechazamos enérgicamente la campaña sucia, cínica que pretende difamar y quitar credibilidad a la lucha histórica del COPINH, igualmente criminalizar nuestra organización. Esta campaña que deslinda a DESA como ejecutora del PH Agua Zarca, se convierte en una herramienta de humillación para comunidades que las exhiben como trofeos dándoles regalías y arrebatándoles el verdadero desarrollo con soberanía, futuro digno y de vida con la complicidad de la Agencia para el Desarrollo del gobierno de Estados Unidos USAID-Proyecto MERCADO como mampara de “desarrollo, empleo, energía limpia y responsabilidad social”.

DESA con una lógica militarista y de “inteligencia” militar, con estrategias que buscan quebrar la voluntad del Pueblo Lenca, la división, imponer terror usando todo tipo de estructura represiva, busca hacer creer ante la opinión pública nacional e internacional que lo existente es un “pleito” entre pobres y continúa negando el derecho y la existencia del Pueblo Lenca, minimizando al COPINH, usando leguajes “educados” y “respetuosos” con asesoría y equipo de publicidad y campañas mediáticas manipuladoras para elevar su perfil y perpetrar su objetivo de obtener millones de Lempiras en ganancias.

El COPINH reafirma su razón como organización Lenca que le apuesta a la descolonización, a la paz con justicia y a lucha contra la privatización y saqueo y reafirma su legado de dignidad y rebeldía de Lempira y de sus gestas emancipatorias y por la autodeterminación y soberanías de los pueblos.

El COPINH llama a la solidaridad nacional e internacional a realizar acciones que contribuyan a frenar y a denunciar estos hechos y política de agresión y de estrategias de las empresas para acaparar y privatizar los bienes comunes y de la naturaleza y de violación sistemática de los derechos del pueblo Lenca.

COPINH: Urgent denouncement

DESA-Agua Zarca reinitiate illegal and illegitimate Hydroelectric Project, Violator of the Rights and Life of the Lenca People and Their Territory

The Government of Honduras continues to permit and be complicit in the violation of the human rights of the Lenca People of Río Blanco and the nothern part of the Department of Intibucá, to support DESA’s second attempt to build the “Agua Zarca” hydroelectric project on the Gualcarque River – a natural heritage, cultural, economic and functional habitat of the Lenca people.

This new attempt by DESA-Agua Zarca is based on the same illegal concession that violates the right to prior, free and informed consultation of the Lenca people, as well as [International Labor Organization] Convention 169, and the UN Declaration on the Rights of Indigenous Peoples, which declares this hydroelectric project since its inception, illegitimate and illegal.

We condemn those that support this project of death, thus making them violators of the historical, individual and collective rights of the Lenca People such as the Development Fund of the Netherlands FMO-Dutch Bank that provides financing of $15 million USD to the project; also the Finnish Fund for Industrial Cooperation Ltd. FINNFUND Finland for $5 million USD; the Central American Bank for Economic Integration with $24.4 million USD; Siemens and VoithHydro companies from Germany; Company of Castro (CASTILLO TORRES) Construction Cerros de Comayagua; the FICOHSA Bank; the Atala family business group, and the United States Government through USAID- Project Mercado [Market] and SERNA, which remain proponents of companies like DESA, and have refused to give information solicited by COPINH for more than 40 hydroelectric projects that affect and violate the rights of the Lenca people, including project Agua Zarca.

We recall that in 2010, the spurious National Congress of Honduras granted dozens of concessions for rivers throughout Honduras, which signifies the full privatization of common goods and nature. Among them, is the concession of the Gualcarque River initially granted to DESA for 20 years. We have demonstrated again and again in different ways, the barbarism and illegitimacy of this project; from the violation of national and international legislation to the forged signatures, repression and murder of several members of COPINH in this area for opposing DESA’s hydroelectric project.

Like in 2013, this project continues to maintain – now with much more support – a military and paramilitary structure disguised with security guards; the disposition of the National Police especially Operation Liberty [Libertad] commanded from Tegucigalpa, for which has been allocated public funds, logistics, communication, and police personnel; the Military Police; and the “TIGRES” organized, financed and trained by the United States. Not sufficing, DESA and the municipal office of San Francisco de Ojuera led by the National Party mayor, Mr. Raul Pineda, proceeded to hire 50 people activists of the National Party, employed by the municipality and the company, paying 200 lempiras a day [approximately $10 USD], plus food, and providing them with weapons – all with support from the municipality.

DESA and Agua Zarca have hired individuals as paramilitary guards, that are known to be responsible for crimes including assassinations, and who have constantly threatened community and national leaders, and companions of COPINH. These individuals are armed. These paramilitary guards have even been arrested for illegal possession of weapons as demonstrated in the arrest of one on December 28, 2015. Those arrested are sheltered by impunity and the influential power of DESA and were released by a public prosecutor and judge from Intibucá, openly supported by favors and money gathered for this purpose to the head of security of DESA- PH Agua Zarca, Jorge Ávila, regardless of criminal history of murder in the case of Bernardo Perez.

DESA-Agua Zarca is destroying the natural riverbed that is a sacred place for the Lenca people, destroying unique ecosystems, biodiversity, fauna, agricultural production, food and natural medicines, and forest that has been devastated by these companies.

Agua Zarca-DESA argues that they redesigned the project, however we want to denounce that PH Agua Zarca is set to be built with the water of the Gualcarque river that is Lenca territory, for which we have undertaken years of struggle in light of the threat of privatization.

Employees and ex-employees of DESA-Agua Zarca and company BLUE ENERGY have taken over and destroyed the Cangel River, that is of equal importance as the Gualcarque river and also born in the Puca Opalaca mountain range. The destruction has produced an action of disrespect and threat to the COPINH delegation that was accompanied on November 7, 2015 by the UN Special Rapporteur on the Rights of Indigenous Peoples and accompanying international delegation; Special Representative Ms. Taulis Corpuz who was detained for a few minutes during her visit.

Like in 2013, the municipal office of Intibucá served as a front man [testaferro] for DESA-Agua Zarca, and is now the mayor of San Francisco de Ojuera, to who we made clear during his visit to the community of Río Blanco, the Lenca people’s rejection of the project to ruin the Gualcarque river, its functions and ecosystems. In this meeting, mayor Raul Pineda and his team were greeted with respect and kindness, but when indigenous representatives mobilized to San Francisco de Ojuera on November 30, 2015 to the municipal offices, we were greeted by the Municipal office, its employees and organized groups of the National party with threats, machetes, guns, accusations and racial abuse, and contempt and hatred of the women and leaders of COPINH for being indigenous and rebellious. Reaching a point of ridiculousness, they made deep trenches in the main road to prevent the passage of the buses in which we were driving, using machinery that DESA-Agua Zarca provided.

A permanent threat to life, physical and emotional integrity exists towards the struggling population of Río Blanco and even against solidarity efforts, accompaniers, human rights observers, journalists, and national and international activists.

We denounce that DESA not only aims to monopolize and destroy the Gualcarque River but now also a connected river, the Guinse river with a series of dams that affect San Francisco de Opalaca, Intibucá and Santa Bárbara.

We strongly reject the dirty, cynical campaign to defame and discredit COPINH’s historical struggle, that equally seeks to criminalize our organization. This campaign which attempts to separate DESA as executor of PH Agua Zarca, becomes a tool of humiliation for communities that are given ‘trophies’ like royalties and disguishing from the people, true development with sovereignty, a dignified future, and life. This is being done with the complicity of the U.S. Agency of International Development (USAID)’s Project Market [Mercado] MARKET Project, under a smokescreen of “development, employment, clean energy and social responsibility.”

DESA with a militaristic logic and military “intelligence”, with strategies that seek to break the will of the Lenca People; divide; and impose fear using all types of repressive strategies, seek to make the national and international public opinion believe that what is occuring is simply a “dispute” between poor people, and continues to deny the rights and existence of the Lenca People, minimizing COPINH, by using “educated” and “respectful” words with advertisements and manipulative publicity and media campaigns to raise its profile and perpetrate their goal of obtaining millions of Lempiras in profits.

COPINH reaffirms its right as a Lenca organization that positions itself in favor of decolonization, peace with justice, and the fight against privatization and looting, and reaffirms its legacy of dignity and rebellion of [the indigenous hero] Lempira and its emancipatory deeds, fighting for the self-determination and sovereignty of all people.

COPINH calls for national and international solidarity to take action to help curb and denounce these acts and policies of aggression and strategies by companies to privatize common goods and nature, and systematically violate the rights of Lenca people.
